Utility Work in the Right of Way

You may have noticed utility work occurring on your property. While many of these facilities are built along the street frontage in public right-of-way (ROW), some use private utility easements in side or back yards. These easements are usually granted when the subdivision was first created to allow for limited use by utility companies to improve lines of communication, quality of life, and life safety.  Existing easement information would be shown on your original plot plan of your lot.

The following should be standard for each utility company completing an expansion project in your area: 

•          Prior notification of the project should be given; either by door hanger, postcard, mailer, etc.

•          Repair/replace all disturbed land/property back to its original state 

•          Respectful treatment of residents and their property 

***Residents with irrigation systems or invisible pet fences are encouraged to mark them.

While the City shares concerns about repeated construction and its impact on neighborhoods, both Federal law and Missouri state statues impose legal limitations on the City’s authority to control utility providers’ access to the public Right-of-Way.  Contractors are required to obtain a ROW Permit from the City before construction begins.  If you have any problems, you should contact the company that is working on your property.
